Question:

Respected SIR,

I was working with North bristol NHS Trust for four and half years and my Perminant Residence was due on December 2009 and on passport, visa is stamped till Nove 2010, June last I resigned and came to Australia and still here. My hospital in UK has agreed to give my job back so if I come back should I have to get a new work permit and furthermore will the immigration department consider my Perminant Residence which was due on Dec 09 as I have only been away from UK for four month or do I have to stay and work in UK for another four more months to complete my 5 year time period.

Thanks and Regards,
Mathew

Answer :

Dear Mathew,
Thank you for your e mail.
I suggest you to check first with your UK employer to confirm whether they have cancelled your work permit. If they have informed the Home Office to cancel your work permit, I am afraid you need to apply for a fresh entry clearance under the point-based system. If not you will be able to return to UK on your current leave to remain. And regarding your Permanent Residence, the Home Office may consider it as a break.

Regards,
Sajeev Kooran
